These Terms of Service (“Terms”) govern your use of this website and the purchase of products from us. By placing an order, you agree to be legally bound by these Terms.

If you do not agree, you must not use this website.

By placing an order, you confirm that:

  • You are at least 18 years old
  • All information provided is accurate and complete
  • You are authorised to use the payment method supplied

We reserve the right to refuse service at our sole discretion.

3. Orders & Acceptance

 

  • All products are subject to availability.
  • Orders are only accepted once you receive written confirmation.
  • We reserve the absolute right to cancel any order for any reason, including but not limited to:
    • Pricing errors
    • Technical errors
    • Suspected fraud
    • Product unavailability
  • If cancelled by us before dispatch, a full refund will be issued.

 

 

4. Perishable Goods & Cancellation Rights

 

 

 

All products sold are perishable, made-to-order food items.

 

Under the Consumer Contracts Regulations 2013, the right to cancel does not apply to:

Goods which are liable to deteriorate or expire rapidly.

Therefore:

  • Once preparation has commenced, orders cannot be cancelled.
  • Same-day and next-day orders are strictly non-cancellable.
  • Customised or personalised cakes are non-refundable under any circumstances.
5. Pricing & Payment

 

  • All prices are in GBP (£).
  • Full payment is required at checkout.
  • We reserve the right to correct pricing errors without liability.
  • If a pricing error is identified, we may cancel the order and refund payment.

We are not responsible for bank charges, payment gateway fees, or currency conversion fees.

 

 

 

6. Delivery Terms
6.1 Delivery Times

 

All delivery times are estimates only. We do not guarantee delivery at a specific time unless explicitly agreed in writing.

We are not liable for delays caused by:

  • Traffic
  • Courier disruption
  • Weather
  • Force majeure
  • Incorrect delivery information
6.2 Risk Transfer

 

 

 

 

Risk transfers to the customer:

  • Upon successful delivery to the address provided
  • If left in a safe place at the customer’s request
  • If delivery is attempted but recipient is unavailable

Once delivery is completed, we are not responsible for product condition.

6.3 Failed Delivery

If delivery fails due to:

  • Incorrect address
  • No recipient available
  • Refusal of delivery

No refund will be issued.

 

Re-delivery fees will apply.




7. Product Condition & Claims



All claims for damage must:


  • Be submitted within 2 hours of delivery
  • Include clear photographic evidence
  • Include original packaging



Failure to comply voids any claim.


Minor cosmetic variations do not constitute damage.


Refunds or replacements are issued solely at our discretion.





8. Storage Responsibility



Customers are responsible for:


  • Storing products according to provided instructions
  • Refrigeration where required
  • Consuming within recommended timeframe



We are not liable for spoilage after delivery.





9. Allergens & Dietary Liability



Products may contain or come into contact with:


  • Nuts
  • Gluten
  • Dairy
  • Eggs
  • Soy
  • Other allergens



We operate in a kitchen handling multiple allergens.


We accept no liability for allergic reactions.


Customers are solely responsible for confirming suitability before purchase.





10. Limitation of Liability



To the fullest extent permitted by law:


  • We exclude all implied warranties.
  • We are not liable for indirect, incidental, or consequential loss.
  • Our total liability shall not exceed the total amount paid for the order.



Nothing excludes liability for death or personal injury caused by proven negligence.





11. Chargebacks & Payment Disputes



If a customer initiates a chargeback:


  • We reserve the right to dispute the claim
  • Delivery confirmation and photographic evidence may be used
  • Fraudulent disputes may result in legal action






12. Intellectual Property



All website content, including branding, text, product names and images, is owned by us.


Unauthorised use is strictly prohibited.





13. Force Majeure



We are not liable for failure to perform due to events beyond our reasonable control, including but not limited to:


  • Natural disasters
  • Government restrictions
  • Transport disruption
  • Supply chain failure






14. Governing Law



These Terms are governed by the laws of England and Wales.


Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
